Reunion
At Ashwood Solicitors, our immigration legal process involves functional solutions for clients no matter your requirements. If you have been granted refugee status while in the UK, there is a possibility that your family members can join you here while also seeking protection.
A Family Reunion Visa application can be complex, so that we would advise seeking the help of an immigration solicitor. At Ashwood Solicitors, we can offer step-by-step guidance when you come to complete the application. We can also assess who in your family qualifies for the assylum passage and assist you with the appropriate documentation to prove the genuine relationship with each family member.
What will you need to prove?
To apply for an EU Settlement Scheme Application, you will need to establish:
Proof of identity and nationality:
- Valid passport or valid national identity.
- Valid biometric residence card.
- Valid biometric residence permit.
Proof of your residence in the UK:
- For settled status, you will need to show five years of continuous residence.
- For pre-settled status in the UK, you need to show current residence in the UK (before 31st December 2020).
The Home Office will check if you have been resident in the UK for a period of five years, and if they can see this, they will then grant a settled status. At Ashwood Solicitors, we will work hard and offer you outstanding legal advice to ensure you are reunited with your family. Every case is different, but you can rely on our team to choose the right approach when it comes to getting visa approval.
Eligibility for Family Reunion
The family members eligible for a reunion are:
- Children under 18
- Your spouse
- Your civil partner
- Your partner with whom you have cohabited for at least two years
By demonstrating to an Entry Clearance Officer that you are related to these people, with marriage or birth certificates, you can prove you are eligible for a family reunion. For children who have been granted refugee status, they may apply for their parents to join them in the UK in some circumstances.
As of recently, there are requirements for maintenance or accommodation, but it will be necessary to demonstrate that your family members are related with the relevant documentation such as birth certificates or passports. Other forms of proof may be able to be used where these are not available, but we can assist you with the necessary documentation.

Our immigration experts provide professional, confidential advice. We also speak a range of languages, including Bengali, Urdu, Polish, Punjabi, Tamil, Malay, Kurdish and Arabic.
We also have a strong network of interpreters to cater to most languages to make communication easier.
Extreme Circumstances
In extreme circumstances, DNA evidence may be required and we can assist in arranging tests overseas. It is possible, in limited circumstances, to argue that children over 18 should be allowed to enter the following separation on a discretionary basis. We can work alongside you to obtain the best evidence possible to put forward your case.
Bringing additional family members to the UK can be possible if this is done via compelling, compassionate reasons; however, this will depend on the circumstances and require an immigration judge to assess the case and evidence.
