What is an Unlawful Eviction?

There are strict procedures and timelines that landlords must adhere to when they want to evict a tenant. There are only a limited number of circumstances where they are legally able to evict.

It can only be done through a court order and if your landlord does not follow the correct legal process, they can face prosecution. Unlawful eviction is a criminal offence (also known as wrongful eviction or illegal eviction); also, bullying or harassing you to leave may be illegal too. 

There are several ways in which a landlord may breach the rules, including:

  • Changing the locks to the property
  • Removing your access to some or all of the property
  • Removing your belongings from the property
  • Threatening or forcing you to leave the property
  • Physically removing you from the property

As a tenant, you can only be forced to leave your rented home if your landlord or their agents have:

  • Served you with the correct notice,
  • Applied to the county court and obtained a possession order, and
  • Obtained a warrant of eviction
