Making a Homeless Application
The council must help if you are legally homeless or threatened with homelessness. You are classed as ‘threatened with homelessness if you are likely to become homeless within 56 days or if you’ve had a valid Section 21 Notice that ends in the next 56 days.
How much help you are entitled to depends on your individual circumstances and can vary from simple advice to temporary accommodation. We can advise on your rights if you are homeless, are making a homeless application, or wish to challenge any decisions made by the Local Authority regarding your homelessness.
At Ashwood Solicitors, we can speak to the council on your behalf, ensuring they make your wellbeing a priority. We will also represent you at housing review meetings and complete any needed paperwork, ensuring it is processed quickly and efficiently.
Challenging a Local Authority Decision
Our team can request a review of a Local Authority’s decision and we can help in the following circumstances:
- Challenging an intentionally homeless decision
- If a Council fails to accept a homeless application
- If the Council refuses to offer temporary accommodation despite the criteria being met
- Offers of unsuitable accommodation
- Supporting an applicant to prove that they meet the five tests of homelessness
- Legally homeless
- Priority need
- Unintentionally homeless
- Eligible for assistance
- Local connection to the area
- Judicial Review & County Court appeals
There are often strict deadlines to request a review of a council’s decision, so it is crucial to contact us as soon as possible.
